Terms And Conditions – Terminal Support Service

When purchasing a Klearly payment terminal, the Terminal Terms and Conditions apply.

• Returns of Klearly payment terminals are not possible.
• For the purchase of a SUNMI L2S PRO, a monthly service fee of €5 excluding VAT per device is charged (SIM card not included).
• For the purchase of a PAX A920 PRO or PAX A77, the monthly service fee is €25 excluding VAT per device (including SIM card).
• For the PAX A35, a monthly service fee of €20 excluding VAT per device applies.

Support And Availability

• Standard support hours for terminals are Monday to Thursday from 09:00 to 18:00 and Friday from 09:00 to 17:00.
• For support with the Klearly payment software, Klearly is available via the regular support number +31 20 308 6360 on weekdays between 09:00 and 18:00.
• For hardware support outside regular hours, Klearly can be reached via the privately communicated emergency number ('the emergency line'):
  • Monday to Thursday from 18:00 to 08:59
  • Friday from 17:00 to 08:59
  • Weekends: 24/7 availability

Warranty And Defects

• Klearly payment terminals come with a 6-month factory warranty. Within this period, a maximum of 1 swaps are free of charge.
• Devices must only be charged using the supplied chargers. Using other chargers voids the factory warranty, and any resulting damage is at your own risk.
• The factory warranty does not cover damage caused by water, drops, theft, or similar incidents. Klearly reserves the right to determine at its discretion whether a defect is covered by the warranty.
• For defects outside the factory warranty, the following fees apply:
  • €75 excluding VAT per SUNMI device
  • €150 excluding VAT per PAX device
• Employees of the reporting party are authorized to report defects and agree to any associated costs, verbally or in writing.

Exchange Policy And Shipping

• When exchanging a defective device, the original device must be returned in its original packaging, including all cables and accessories.
• If the defective device is not returned, the following amounts will be invoiced:
  • €449 per PAX device
  • €399 per SUNMI device
    (advised retail prices)
• If a defective PAX device is reported before 12:00 on a business day, a replacement device will be sent the same day (subject to applicable terms).
• If a defective SUNMI device is reported before 12:00, the replacement device will be shipped the next business day.

Urgent Replacement And Call-Out Fees

• For urgent deliveries, the provincial fee applies plus €150, excluding VAT.
• For urgent replacement of a PAX device, a one-time provincial fee applies based on location: Noord-Holland: €65,-; Zuid-Holland: €50,-; Zeeland: €120,-; Utrecht: €65,-; Noord-Brabant: €100,-; Limburg: €150,-; Gelderland: €120,-; Overijssel: €180; Flevoland: €150,- Drenthe: €200,-; Groningen: €230,-; Friesland: €200,-
• Urgent replacement of SUNMI devices is not possible.

Cancellation Of Service Package

• Service packages can be canceled monthly with a one-month notice period.
• Cancellation must be submitted in writing via support@klearly.nl and received before the end of the current month to take effect the following month.
• Upon termination of the service package, the terminal device will be reset the following month, and the Klearly app will no longer be usable.

Other Provisions

• It is not possible to purchase a Klearly payment terminal without agreeing to these terms and conditions.
• The payment terminals and other equipment supplied by Klearly are intended solely for use by the counterparty within the Klearly ecosystem. Without Klearly’s prior written consent, it is prohibited to sell, lease, transfer, or otherwise make the equipment available to third parties. Violation of this prohibition will result in the forfeiture of all claims to warranty, maintenance, and service.
• Klearly collaborates with Coretechd B.V. (Chamber of Commerce number 72578297) for service and support.
• Dutch law applies to these terms and conditions.
• Klearly’s privacy policy can be found in the Klearly app.
• These terms were last updated on May 16, 2025, and may be amended periodically.
